Provisional text: to be reviewed and completed before the site is published. Passages marked To be completed are waiting for information from the publisher.
This text describes the usage and billing rules chosen for Aptys Eval. It is not in force yet: it must be reviewed by a lawyer and completed by the publisher. No order can be placed on this site: a plan is taken in the application, after access has been opened.
1. Purpose
Aptys Eval is a web application that lets independent units prepare and run selections (sports tests, interviews, role-plays): programme, evaluation grids, entries, results, opinion and decision meetings.
These terms govern access to the application and the billing of its use by an organisation (“the organisation”). Publisher: To be completed
2. Opening access
Access is requested through the site form. The request is reviewed by the publisher, who may refuse it or ask for more information. On activation, a unit is created for the organisation, with its first administrator. No payment is requested at this stage.
A read-only example session comes with each unit: it is never billed.
3. The plan
Use is billed by plan: one plan per opened phase, or a single plan for a session without phases. The final review of a phased session is never billed, nor is a planned phase that is never opened, nor the example session. Reopening a closed phase does not create a new plan.
The plan depends on the number of activity days. When opening, the session manager chooses a tier (1, 2, 3, 5, 7 or 10 days); the chosen tier can only go up.
An activity day is a calendar day, in the session’s time zone, on which at least one evaluation entry or observation of the phase was recorded. The day starts at 4 a.m.: an entry made at 1 a.m. belongs to the previous day. For an entry copied from paper, the date of the measurement counts, not the date of the copy. For an entry made offline, the device time counts, unless it differs by more than 24 hours from the time of receipt: the server time then prevails.
If activity days exceed the chosen tier, the next tier applies automatically; beyond the last tier, each additional day is billed at the additional-day price. A selection is never interrupted for this reason.
4. Prices
Plans: 1 day : 180 CHF ; 2 days : 320 CHF ; 3 days : 450 CHF ; 5 days : 650 CHF ; 7 days : 850 CHF ; 10 days : 1 100 CHF. Beyond 10 days: 90 CHF per additional day. Prices in Swiss francs, To be completed (taxes included or not).
The applicable grid is the one in force when the plan is opened; it is recorded with the plan. A price change never alters a plan that is already open.
The organisation accepts the prices and these terms before its first opening, and again for each new version. A first free plan may be granted when the unit is activated.
5. What is included
The plan includes unlimited evaluators, field mode (offline), meetings and the final review, and the AI-assisted summary if the organisation turns it on, up to 60 candidates per activity day.
Not included, and sold separately: set-up, training and other services. Larger structures (more than 60 candidates per day, more than 100 members, several units) are quoted individually.
6. Invoicing and payment
“On invoice” mode (default): the invoice is issued after the plan is opened, payable within 30 days. The organisation may provide an annual purchase order; its reference then appears on each invoice. A purchase-order ceiling only triggers a warning, never a block.
“Prepaid” mode (at the publisher’s decision, per organisation): the manager requests the plan in the application and pays the amount by bank transfer, and the publisher validates the plan once payment is received. Opening the phase waits for this validation; a phase that is already open is never blocked, and exceeding a tier is billed afterwards.
Late payment: To be completed (reminders, penalties, deadlines). The publisher may suspend the organisation’s unit; nothing is deleted during the suspension, and access is restored on reactivation.
7. Obligations of the organisation
The organisation designates its candidates by a number and never by name in the application. It gives each person the appropriate role (manager, evaluator, observer, guest) and keeps decisions human: the application never admits or eliminates anyone automatically.
It protects its credentials, ensures its selection is lawful and respects the rights of the people evaluated. It exports its results before the end of the retention period (article 9).
8. AI-assisted summary
The summary is optional and off by default; only the unit’s administrators can turn it on. It produces an informative text about a candidate, designated by number, from their results and observations: summary, strengths and weaknesses. It never recommends, ranks or decides.
To produce it, the application sends this data, without names, to an external artificial intelligence service (Claude API, Anthropic). Each text is labelled “Generated by AI” and dated. To be completed (subcontracting, place of processing, retention by the provider).
9. Data, privacy and retention
Data processing is described in the privacy policy. The organisation remains responsible for processing its candidates’ data; the publisher acts on its behalf. To be completed
A session is kept for three months after its first complete closure (or first freeze), then deleted; a draft that was never started is deleted 90 days after its last change. Reminders at 30 and 7 days invite the organisation to export its results locally. An open session is frozen, not deleted, 90 days after its planned end or at most 12 months after it first started. Billing records survive a deleted session; they contain no candidate and no result.
10. Availability, backups and liability
The publisher uses reasonable means to keep the application available and backed up. Field mode allows evaluation to continue without a connection. To be completed (service level, maintenance windows, limits and cap on liability).
11. The application’s data is authoritative
Activity days, tiers and amounts are those recorded by the application; they are authoritative between the parties, unless proven otherwise. The organisation may contest a plan by writing to the publisher: the opening, the days counted and the billing actions are logged and can be shown to it.
12. Term, termination and changes
Term and termination: To be completed. The publisher may change these terms and the prices; the new version is shown to the organisation, which accepts it before its next opening. Plans already open remain governed by the version applicable when they were opened.
13. Applicable law and disputes
Applicable law, jurisdiction and dispute resolution: To be completed
